2 What is personal data?

Personal data is any information relating to an identified or identifiable natural person. 4 What applies to business activities with us?

With the following information, we would like to provide you as a customer, business partner, supplier or interested party or as their contact person with additional information about our processing of personal data:

(1) We process personal data in particular

a) to carry out pre-contractual measures and/or to fulfill a contract, including any warranty, guarantee and return cases (legal basis Art. 6 para. 1 sentence 1 lit. b GDPR),

b) to fulfill legal obligations (legal basis Art. 6 para. 1 sentence 1 lit. c GDPR) and

c) to safeguard our legitimate interest in protecting our assets, preventing payment defaults, enforcing or defending our rights and - in the case of personal data of contact persons in companies - to be able to identify and contact the contact persons of our customers, interested parties, suppliers and other business partners for the purpose of conducting or initiating business relationships (legal bases are Art. 6 para. 1 sentence 1 lit. b and lit. f GDPR).

(3) When you create an account in the webshop under "Login/Register", the data you provide will be saved. Mandatory fields are marked as such; the other information is voluntary. The legal basis for this is Art. 6 para. 1 sentence 1 lit. b and lit. f GDPR. Without the provision of complete and correct basic data, it is not possible to set up a customer account, as we need the data you provide to process your order(s). The provision of voluntary data is not required.

(4) If you use our webshop, it is necessary for the conclusion of the contract that you provide your personal data. Mandatory information required for the processing of contracts is marked separately, other information is voluntary. We process the data you provide to process your order. The legal basis for this is Art. 6 para. 1 sentence 1 lit. b and lit. f GDPR.

(5) We collect and process the data required for the aforementioned purposes. It is not possible to place an order with us without providing the data (marked as mandatory fields in the web store). You do not have to fill in the optional data fields in the web store. The return of goods and the assertion of your warranty rights are also not possible without the provision of the required information.

(6) We may also process the data you provide in order to inform you about other interesting products from our portfolio or to send you e-mails with technical information (e.g. about hardware recalls affecting you and current IT security risks). (7) We offer the payment method delivery on account and protect ourselves against payment risks by obtaining a credit report (data on the customer's creditworthiness, credit check) for each new customer either from Creditsafe Deutschland GmbH, Schreiberhauer Straße 30, 10317 Berlin, or Creditreform Trier Eberhard KG, Ostallee 3, 54290 Trier. (8) Personal data is passed on to internal departments insofar as this data is required for the proper fulfillment of tasks. In some cases, we use external service providers to process personal data. (9) Data transfer to third countries (countries outside the European Union or the European Economic Area) may be necessary in individual cases, e.g. for the performance of the contractual relationship. We point this out separately in the respective offer. We always comply with Art. 44 et seq. GDPR are always observed.

(10) We do not use automated decision-making, including profiling.

(11) Your personal data, including address, payment and order data, are regularly deleted when they are no longer required for your request or the execution of the contract or any reversal and expiry of any additional statutory retention periods (e.g. up to 10 years according to the German Commercial Code or Tax Code). Your personal information data (including name, address, date of birth if applicable and the credit report provided by the credit agency) will be stored for a period of one year. One of the purposes of this is to ensure that a new credit check does not have to be carried out for future invoice purchases. In addition, we may retain personal data if you have given us your permission to do so or if legal disputes arise and we use evidence within the scope of statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

5. what applies to events and web seminars at IT-HAUS GmbH ?
With the following information, we would like to inform you as a customer, business partner, supplier or interested party or as a contact person additionally about our handling of the processing of personal data for events and web seminars of IT-HAUS GmbH .

(1) Data that you send to us as part of your registration for our respective event or web seminar will be processed by us as part of your registration - naturally on the legal basis of the GDPR and the BDSG.

(2) We use our CRM system (Customer Relationship Management) from Microsoft Dynamics 365 of Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18 D18 P521 (hereinafter: "Microsoft") on our website to register for the respective event or web seminar.

Alternatively, we use the LinkedIn event form to register for our event and process the contact details and information provided by users or LinkedIn members for this purpose. Mandatory fields in the registration form (usually: first name, surname, company, email address) are marked as such; the remaining information is voluntary and therefore does not have to be provided by you. We process the data to confirm your registration for the event and to send you information from and about the event.
For this purpose, LinkedIn stores the data (first and last name, e-mail address, company) and transmits it. When using this registration process, please note that LinkedIn also processes your personal data in the USA.

When registering for the respective event or web seminar, the data you provide will be stored. Mandatory fields in the registration form (usually: first name, surname, company, e-mail address) are marked as such; the other information is voluntary and therefore does not have to be provided by you.

We process your personal data

a) to fulfill the contract or to carry out pre-contractual measures (legal basis Art. 6 para. 1 sentence 1 lit. b GDPR; establishment, content or modification of a legal relationship),

b) to fulfill legal obligations (legal basis Art. 6 para. 1 sentence 1 lit. c GDPR) and

c) to safeguard our legitimate interest in being able to identify and contact the contact persons of our customers, interested parties, suppliers and other business partners for the purpose of conducting or initiating business relationships (legal bases are Art. 6 para. 1 sentence 1 lit. b and lit. f GDPR).

Registration is not possible without the provision of complete and correct mandatory information, as we need the data you provide to properly conduct the respective event or web seminar. The provision of voluntary information is not required.

(3) When you contact us by e-mail, the data you provide (your e-mail address, if applicable: title, your first and last name, as well as your company and your address) will be stored by us in order to answer your inquiries. The legal basis is Art. 6 para. 1 sentence 1 lit. b and lit. f GDPR.

(4) When you contact us via the "Do you have any questions?" callback form on the event page, the data you provide (your telephone number is mandatory, all other information is voluntary) will be stored by us in order to answer your inquiry. (5) We may also process the data you provide in order to inform you about other interesting products and events/web seminars from our portfolio or to send you e-mails with technical information. (4) Your data will be deleted without your consent six months after the rejection has been sent, in accordance with Section 61b (1) ArbGG in conjunction with Section 15 AGG. § SECTION 15 AGG. If you have given your consent, your personal data will be stored for 360 days from the date of refusal, after which it will either be deleted or a new request for consent will be made. 8th Newsletter

(1) With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers. The advertised goods and services are named in the declaration of consent.

(2) We use the so-called double opt-in procedure to register for our newsletter via the website. (5) We would like to point out that we evaluate your user behavior when sending the newsletter. The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR. For this analysis, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. (1) We use the Friendly Captcha service on our website. Friendly Captcha is an innovative, data protection-friendly protection solution to make it more difficult for automated programs and scripts (so-called "bots") to use our website. The provider of this service is Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee, Germany.

(2) Friendly Captcha is used to check whether the data input on our websites (e.g. in a contact form) is made by a human or by an automated program. For this purpose, a program code from Friendly Captcha has been integrated on our website so that the visitor's end device can establish a connection to the Friendly Captcha servers in order to receive a calculation task from Friendly Captcha. The visitor's end device solves the calculation task and sends the calculation result to our web server. This server connects to the Friendly Captcha server via an interface Contact and receives a response as to whether the task was solved correctly by the end device. We have provided our website with appropriate security rules and can therefore process or reject these requests depending on the result.

(3) Your IP address and a timestamp will be transmitted to Friendly Captcha. IP addresses are only stored in hashed (one-way encrypted) form and do not allow us or Friendly Captcha to draw any conclusions about an individual person. The data will be deleted after 30 days.

(4) The legal basis for the processing is our legitimate interest in protecting our website from abusive access by bots, as well as spam protection and protection against attacks (e.g. mass requests), Art. 6 para. 1 sentence 1 lit. a GDPR. Friendly Captcha does not set or read any cookies on the visitor's end device.

The personal data that may be accessible to us here is used by us exclusively for the purpose of secure and efficient provision, analysis and optimization of our podcast offer based on our overriding legitimate interest (Art. 6 para. 1 sentence 1 lit. f GDPR).
